These Terms and Conditions ("Terms") govern your use of the website operated by Gardenwell ("we", "us", or "our") at gardenwell.ie and your initial interactions with us regarding our premium garden design and outdoor wellness design services in Ireland.

By accessing this website or submitting an inquiry through our contact form, you agree to be bound by these Terms. If you do not agree, please do not use this website.

2. About Gardenwell

Gardenwell provides high-end garden design, layout planning, and planting concepts for residential outdoor spaces, with a focus on beautiful, buildable designs suited to Irish conditions. We serve clients primarily in Dublin, Kildare, and Meath.

Information on this website is intended to describe our design approach and services at a general level. It does not constitute a binding offer unless expressly confirmed in writing.

3. Website Use

You agree to use this website only for lawful purposes and in a manner that:

All content on this website — including but not limited to text, branding, logos, graphics, photographs, portfolio images, layout drawings, planting plans, mood boards, 3D renders, design concepts, and any other creative or technical material displayed or referenced — is the intellectual property of Gardenwell or its licensors and is protected by copyright and other applicable intellectual property laws.

Unless we provide written permission, you must not:

  • copy, reproduce, download, or redistribute our design work, renders, or photography;
  • use our images or concepts for commercial purposes, portfolios, or marketing;
  • modify, reverse-engineer, or create derivative works from our designs; or
  • present our work as your own or pass it to third parties without authorisation.

Where Gardenwell prepares bespoke design material for a client under a separate written agreement, ownership and usage rights will be defined in that individual client contract. Until such rights are expressly assigned or licensed in writing, all design outputs remain the property of Gardenwell.

5. Inquiries and Client Engagements

Submitting our contact form or communicating with us does not create a client relationship or contractual obligation on either party. Any design engagement, fee, deliverables, timelines, revisions, and scope of work will be set out in a separate written proposal or client contract agreed between you and Gardenwell.

In the event of any conflict between information on this website and a signed client contract, the signed client contract shall prevail.

6. Limitation of Liability

The content on this website is provided for general informational purposes only. While we aim to present accurate and thoughtful information about our design services, we make no warranty that all content is complete, current, or suitable for every individual project.

To the fullest extent permitted by applicable law:

  • Gardenwell shall not be liable for any loss or damage arising from your reliance on website content alone when making decisions about a garden or outdoor project.
  • We are not responsible for third-party websites linked from this site, nor for technical interruptions or errors beyond our reasonable control.
  • Any liability relating to design services, deliverables, or project outcomes is governed by the relevant individual client contract, not by these website Terms.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the laws of the Republic of Ireland, including liability for fraud or for death or personal injury caused by negligence where such limitation is not permitted.

7. Disclaimer

Garden design outcomes depend on site conditions, budget, permissions, contractor execution, planting establishment, weather, and ongoing maintenance. Visual representations (including photographs and 3D renders) are illustrative and may differ from final built results. We design with buildability and Irish conditions in mind, but actual outcomes require professional on-site assessment and appropriate construction or horticultural works.

8. Privacy

Your use of this website and any personal data you provide is also governed by our Privacy Policy , which explains how we collect and process personal information in accordance with GDPR and Irish data protection law.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Ireland, without regard to conflict of law principles.
